Adult-use cannabis is illegal in Wisconsin and the state does not have a legal medical cannabis program, although it does allow the use of CBD oil. In August 2021, state lawmakers unveiled a bill to legalize marijuana for adults. The state already borders two cannabis-legal states — Illinois and Michigan — and a number of local jurisdictions in the state have taken steps to reduce penalties for minor cannabis-related offenses. Recreational cannabis came into effect in May 2022 and retail sales are expected to begin as early as December 2022. Sales will begin at existing medical pharmacies, while up to 33 adult pharmacies will receive licenses. The first dispensaries opened in Michigan in December 2019, a year after voters approved a vote to legalize recreational cannabis. More than a decade earlier, in 2008, the state approved medical marijuana and added 11 new eligibility requirements in 2018, including chronic pain, autism and inflammatory bowel disease.
The state also honors out-of-state medical marijuana licenses and allows adults to grow up to 12 marijuana plants privately. Mississippi offers limited reciprocity to out-of-state patients who register with the state. Recreational cannabis is not legal. Possession of 30 grams or less is not punishable for a first offence and is an offence for the second and third offences.
